These Terms of Service ("Terms") govern your use of the Nigh mobile application ("the App"). By downloading, installing, or using Nigh, you agree to these Terms.
Nigh is a GPS-based departure time calculator that helps you leave on time for events. The App uses your device's location services and Apple Maps to estimate travel times and provides departure reminders through notifications and Live Activities.
Free Trial: New subscribers may be eligible for a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the listed price.
Payment: Payment is charged to your Apple ID account at confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
Cancellation: You may cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
Price Changes: We may change subscription prices at any time. Price changes take effect at the start of the next billing period. You will be notified in advance and given the option to cancel.
Nigh provides estimated departure times based on GPS location data and Apple Maps travel time calculations. These estimates are approximate and may be affected by traffic conditions, GPS accuracy, route changes, and other factors. Nigh does not guarantee you will arrive on time. You are responsible for planning appropriate buffers and using your own judgment.
You may use Nigh for personal, non-commercial purposes. You agree not to:
Nigh and all associated content, features, and functionality are owned by the developer and are protected by copyright, trademark, and other intellectual property laws.
To the maximum extent permitted by law, Nigh and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of the App. Nigh is provided "as is" without warranties of any kind.
Nigh requires access to your device's location services to function. You may revoke location access at any time through your device settings, but this will limit the App's functionality. See our Privacy Policy for details on how location data is handled.
We reserve the right to modify or discontinue the App at any time. We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the United States. Any disputes will be resolved in accordance with applicable law.
